Great News! The Georgia Department of Revenue recently announced an additional tax refund that will be issued to all Georgia taxpayers who’ve filed their 2021 tax returns.

The Georgia General Assembly recently passed, and Governor Kemp signed, legislation allowing for an additional refund of income taxes from 2020 (HB 1302 Tax Refund) to be paid to Georgia taxpayers due to a state revenue surplus.

The Georgia Department of Revenue has already began issuing the refunds, and it anticipates issuing most of the special, one-time tax refunds by early August for Georgia taxpayers who filed a Georgia income tax return by April 18, 2022.

The Department of Revenue will attempt to include the refund along with other refund amounts due. For taxpayers whose 2021 returns have already been processed, the GA Department of Revenue will issue a separate refund payment via paper check or ACH direct deposit beginning in May with the goal of issuing most refunds by August.

Single filers and married individuals who file separately could receive a maximum refund of $250. Head-of-household filers could receive a maximum refund of $375. Married individuals who file joint returns could receive a maximum refund of $500. The refund amount will be based on an individual’s tax liability. If taxpayers owed less than the maximum amounts listed above, they will only receive a refund for their actual tax liability.

Any Georgian who was a full-year resident in 2020 and 2021 and who also filed a Georgia individual income tax return for 2020 and 2021 is eligible for the refund. Part-year and nonresident filers who file Georgia individual tax returns for both years (2020 and 2021) will be eligible for a proportional refund equal to the maximum amounts based on filing status multiplied by the share of their income taxable in Georgia.

Taxpayers expecting the refund will receive it in the form of a paper check mailed to the address used on their 2021 return. If taxes were paid in 2021 by ACH credit, or if banking information was provided for a 2021 refund, the refund will be received as a direct deposit.

To be eligible to receive your HB 1302 Tax Refund, you must have filed your 2021 tax returns. We encourage anyone who hasn’t filed their 2021 tax returns not to wait and file as soon as possible.
